Terms of Service & Privacy Policy

These Terms of Service and this Privacy Policy (together, the “Terms”) govern your access to and use of VitalisMed, an educational and documentation-support product operated by VitalisMed LLC (“VitalisMed,” “we,” “us”). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use VitalisMed.

1. Educational use only — no medical advice

VitalisMed and its AI assistant, Vitalis, are provided for educational and documentation-support purposes only. They do not provide medical advice, diagnosis, or treatment, and do not create a doctor–patient or any professional relationship. Outputs may be incomplete or incorrect and must not be relied upon for clinical decisions. Always defer to a qualified, licensed clinician and your own professional judgment. In an emergency, call your local emergency number (911 in the US). If you are in crisis, call or text 988 (US Suicide & Crisis Lifeline).

2. No protected health information (PHI)

You agree not to enter real, identifiable patient information (including PHI as defined under HIPAA) into VitalisMed. Use only de-identified, fictional, or non-identifying content. VitalisMed is not a HIPAA-covered service and is not intended for the storage or processing of PHI. You are solely responsible for the content you submit and for ensuring it contains no PHI.

3. Eligibility & accounts

• You must be at least 18 years old to use VitalisMed.
• You are responsible for the accuracy of your account information and for keeping your password secure.
• You are responsible for all activity that occurs under your account.
• Notify us promptly of any unauthorized use at vitalismedsupport@gmail.com.

4. Acceptable use

You agree not to:

• Use the service to obtain a diagnosis or treatment plan for a real person, or present outputs as medical advice.
• Submit unlawful content, another person's PHI, or content you don't have the right to submit.
• Attempt to disrupt, overload, reverse-engineer, scrape, or gain unauthorized access to the service.
• Resell or misrepresent the service, or use it to build a competing dataset or model.

5. AI processing by third parties

VitalisMed uses third-party artificial-intelligence providers (currently Anthropic) to generate summaries, notes, and chat responses. Content you submit for these features is transmitted to and processed by those providers to produce your output. By using these features you consent to that processing.

6. Subscriptions & billing

Paid plans, where offered, are billed on the cadence shown at checkout (monthly or annually). Plan limits reset monthly. Prices may change with notice. Except where required by law, payments are non-refundable. You may change or cancel your plan at any time; changes take effect as described at the time of the change.

7. Intellectual property

The VitalisMed software, branding, and design are owned by VitalisMed LLC. You retain rights to the content you submit; you grant us a limited license to process it solely to operate and provide the service.

8. Disclaimers & limitation of liability

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, VitalisMed LLC and its affiliates will not be liable for any indirect, incidental, special, or consequential damages, or for any clinical outcome, decision, or action taken in reliance on the service. Our total liability is limited to the amount you paid us in the twelve months before the claim.

9. Indemnification

You agree to indemnify and hold harmless VitalisMed LLC from claims arising out of your content, your use of the service, your violation of these Terms, or your submission of PHI.

10. Termination

You may delete your account at any time from Account settings. We may suspend or terminate access for violations of these Terms. Certain provisions (disclaimers, liability limits, indemnification) survive termination.

11. Changes & governing law

We may update these Terms; material changes will be posted with a new “last updated” date. Continued use means acceptance. These Terms are governed by the laws of the United States and the state in which VitalisMed LLC is organized, without regard to conflict-of-laws rules.

12. Privacy — information we collect

• Account information: your name, email address, professional role, and a securely hashed password.
• Content you submit: text you paste, files you upload, transcripts of voice recordings, chat messages, and the outputs generated for you.
• Usage data: counts of features used, your plan, and basic technical logs needed to run and secure the service.

13. How we use information

• To provide the service — generate summaries, notes, and responses, and save your library.
• To operate your account, enforce plan limits, and process any payments.
• To secure the service and prevent abuse.

We do not sell your personal information, and we do not use your content to train our own models.

14. Sharing & AI providers

We share content with service providers strictly to operate the service — notably our AI provider (Anthropic), which processes submitted content to generate outputs, and infrastructure/payment providers. These parties are bound to use the data only to provide their services to us.

15. Data retention & deletion

Your content and account data are retained while your account is active. You can delete your account at any time from Account settings; doing so permanently deletes your account and your associated records, conversations, and usage data from our database. Some minimal logs may persist briefly for security and legal compliance.

16. Your rights

Depending on your location (including under GDPR and CCPA), you may have the right to access, correct, or delete your personal information, and to request a copy of it. You can exercise deletion directly via the delete-account feature, or contact us for other requests.

17. Cookies

We use a single essential, HTTP-only session cookie to keep you signed in. We do not use advertising or cross-site tracking cookies.

18. Children

VitalisMed is not directed to anyone under 18, and we do not knowingly collect information from children.
